Did you purchase or use a Philips respiratory and sleep therapy product that was subject to a recall?

The claims period has ended. The deadline to submit a claim was March 7, 2026. The Administrator is finalizing the review of the claims that were submitted. Everyone who submitted a claim will receive a claim determination notice with important information about their claim, including any approved devices. Please read this notice carefully. Payments for approved claims will begin in May 2026. Payments will be sent by e-Transfer or cheque, in accordance with the instructions you provided on your claim form. If you have chosen an e-Transfer payment, you will receive a separate email before the payment is sent. Please check your inbox, junk, and spam folders. If you are receiving your payment by cheque, it will be mailed to the address provided on the claim form. Be advised that you do not need to pay any fees to receive your settlement payment. If you receive a message that seems suspicious or asks you to pay money to receive your payment, please contact the Administrator at cpapsettlement@kpmg.ca before responding.

Background

A class action was filed concerning Philips Respironics sleep apnea machines and ventilators. Millions of these products, recalled by Philips in the United States on June 14, 2021 and by Health Canada on June 23, 2021, were manufactured with a Polyester-Based Polyurethane (PE-PUR) foam. This foam can degrade into toxic particles that users may inhale or ingest, potentially causing serious health issues such as cancer, respiratory damage, inflammation, nausea, and headaches.

The class action focuses on CPAP, BiPAP, and mechanical ventilator devices marketed by Philips and related companies.
